Although the Prime Minister of Armenia, Nikol Pashinyan, made several public statements recognizing the territorial integrity of Azerbaijan, he does nothing to remove the Karabakh clause from the Armenian constitution.
What is Pashinyan's goal here? Why does not change?
Rasim Musabayov, a deputy of the Azerbaijan Milli Majlis, emphasized that this decision is not the problem of Azerbaijan, but of Armenia.
"This is the decision taken during the USSR period regarding the unification of Armenia with Karabakh. This decision is referred to even after the declaration of independence was adopted in 1989. Later, after the adoption of the Constitution of Armenia, it is stated that this is a continuation of the declaration of independence. In this case, Armenia cannot cancel the decision made during the USSR. If Armenia recognizes the territorial integrity of the Republic of Azerbaijan, I do not think that this is of great importance. This decision will be Armenia's problem, not ours. Azerbaijan does not guarantee its territorial integrity with a piece of paper. This is provided by our army."
Armenian political activist Ishkhan Verdiyan, in his statement to our website, called this decision a time bomb in the Armenian legislative system.
"As someone who knows the Constitution of the Republic of Armenia at a certain level, I can say that there is no word about Karabakh in this document. Territorial claims against Azerbaijan and Turkey were mentioned in the Declaration of Independence, which in turn formed the basis of the Constitution. Prime Minister Pashinyan has the necessary authority to amend the Constitution, but the law does not specify the procedure by which he can initiate changes to the text of the Declaration of Independence. Thus, any amendment to the constitution cannot change the content of the document it refers to. The Declaration of Independence takes precedence over the constitution and all other laws, and as such, it is inviolable.
The Declaration of Independence of the Republic of Armenia was adopted at the initiative of the "Karabagh Committee", which controlled the political situation in the Armenian SSR at that time and took over the official power in independent Armenia a year later. This committee was the author of the infamous lines in the declaration touching on the territories of neighboring countries. Thus, a kind of bomb was planted in the legislative system of the country, which is almost impossible to defuse legally. That is, if we only follow the Constitution, then Armenia cannot have a territorial claim against its neighbors. This declaration cannot be rewritten. The only solution I see in this situation is to abolish the existing Constitution and adopt a new Constitution that will refer to different principles. Maybe Prime Minister Pashinyan will make such a decision someday, but he is unlikely to do it now, he does not want to expose the country to a new stress."
